Lawyer requests town documents for library appeal

Source: Town of Rockport A lawyer for Steven Earle has filed a Freedom of Access request with the town of Rockport for documents related to the library building permit.

Rockport — The lawyer representing Stephen Earle, a neighbor of the Rockport Public Library who is appealing the building permit for the library, has filed a Freedom of Access request with the town for documents related to the library’s construction.

Jeffrey P. Mellor of the law firm Strout & Payson submitted the request to the town July 24. The FOA requests the opportunity to inspect or obtain any correspondence to or from former Town Manager Rick Bates and Select Board member Doug Cole regarding the construction of the library, as well as any communications between town employees and Phi Builders + Architects.

The FOA also requests the file related to the town’s previous unsuccessful efforts to have the library built from November 2016 and “all documents reflecting the town’s course of action relative to the appointment of the two newest Zoning Board of Appeals members.”

Thomas Kennedy, W. Kevin Olehnik, and Geoffrey Parker were appointed to the ZBA by the Select Board at the July 8 meeting.

The Zoning Board of Appeals is scheduled to hear the appeal Wednesday, Sept. 11, at the Geoffrey C. Parker Community Meeting Room at the Rockport Opera House.

The appeal was initially scheduled for Aug. 14, but has been delayed to provide board members more time for appropriate training, according to administrative assistant for Assessing, Planning and Codes Hannah Sisk.

At its Aug. 14 meeting, the ZBA will elect a chair and vice chair and receive training conducted by William Kelly Esq. of the law firm Kelly & Associates

Town Clerk Linda Greenlaw, who served as acting town manager for the month of July before new Town Manager Bill Post took over the position Aug. 1, said the town is in the process of gathering materials, as well as estimating the time the retrieval process will take and the associated costs.
