Jury returns guilty verdict in Diana murder trial
Rockland — After deliberating for several hours July 26, a Knox County jury found Arnold A. Diana guilty of murdering Katrina Windred.
Defense attorney Christopher MacLean and prosecutor Lisa Marchese, an assistant attorney general, made their closing arguments Thursday morning, July 26 in the ninth day of the trial in Knox County Superior Court.
The prosecution argued Diana, 37, of Rockland strangled Windred on Nov. 20, 2010, at the Thorndike apartment building where he lived. "This case is about the fact that Arnold Diana was unable to handle the breakup of his relationship with Katrina Windred," Marchese said early in the trial.
Windred was 48 years old and lived in Friendship.
The defense attorney, however, said Diana was in a love triangle with two women, and that the other woman would go into jealous rages over Windred. "Someone else might have had motive and opportunity," said MacLean, who argued for an alternative suspect.
Diana will be sentenced in mid-October following a pre-sentencing investigation expected to take 45 days. An old probation violation motion from Waldo County will be addressed at sentencing. Meanwhile, he will be held without bail.
After the verdict was announced, MacLean asked for a polling of the jury.
Presiding Justice Jeffrey Hjelm thanked the jury for its effort, beginning with the first day of jury selection on July 13 to the end of the trial July 26.
"You have preserved the right we all have, that is a trial by jury," he said.
"We carefully evaluated all of the evidence," Marchese said after the trial. "I thought we had a good case."
Defense attorney MacLean said his client "was disappointed with the verdict."
"But we have respect for the verdict and the process," he said.
MacLean said he and his client will review the legal points for a possible appeal.
"There's a 21-day deadline for an appeal after sentencing," he added, "and that's sometime in mid-October."
